Terms of Use

Effective date: 30 September 2026

Please read these Terms carefully before purchasing or using BrightThrough. They govern your access to and use of BrightThrough and related services.

1. About BrightThrough

BrightThrough is a workplace navigation and decision-support product operated by Maltzman Aizen Monica in Uruguay ("BrightThrough", "we", "us", or "our"). These Terms apply to BrightThrough and to the related pages and services we operate through monicamaltzman.com or an approved BrightThrough subdomain.

Questions about these Terms can be sent to help@monicamaltzman.com.

2. Eligibility and acceptance

BrightThrough is intended for adults aged 18 or older.

Before you complete a BrightThrough purchase, you are given access to these Terms, the Privacy Notice, and the Refund Policy. By completing your purchase, you agree to these Terms and acknowledge the Privacy Notice and Refund Policy. If you later create, activate, or continue to use a BrightThrough account, your use remains subject to the Terms that apply to you.

If you purchase BrightThrough through Gumroad, your transaction is also subject to Gumroad’s applicable terms and policies. Gumroad acts as Merchant of Record for the transaction; these BrightThrough Terms govern your access to and use of BrightThrough.

3. Your account and access

To use BrightThrough, you need a valid account and valid access associated with your purchase. Signing in alone does not create or prove a right to use a paid BrightThrough product.

You are responsible for keeping your account credentials reasonably secure and for providing accurate information where the product requires it. Your access is personal to you unless BrightThrough expressly provides another type of access. You may not sell, transfer, share, or sublicense your account or access except where we expressly permit it.

If you change your verified account email, we may keep a record of the original purchase email to help verify your purchase, restore access, and prevent duplicate purchases. This does not transfer your access to another person.

4. What BrightThrough provides

BrightThrough helps users understand difficult or harmful workplace situations, build a plan for a specific situation, prepare to use that plan, handle the situation as it develops, and review what happened and decide what to do next.

BrightThrough is not your employer, HR department, HR representative, investigator, lawyer, therapist, medical provider, union representative, emergency service, or other professional adviser. It does not file complaints, represent you in a workplace process, investigate allegations, or make decisions on behalf of you, your employer, or another organization.

The service may help you consider options, wording, documentation, boundaries, escalation, outside support, or larger decisions. You remain responsible for deciding what to do and for obtaining qualified professional help when your circumstances require it.

5. Safety and professional support

If a situation involves immediate danger, violence, a medical or mental-health emergency, unlawful conduct requiring urgent intervention, or another circumstance that requires qualified professional help, use the appropriate local emergency, safety, legal, medical, mental-health, union, or other professional resource. Do not rely on BrightThrough as the sole response to an emergency or a situation requiring professional representation.

6. Information and content you provide

You keep your rights in the information and content you enter into BrightThrough. You give us permission to process that content only as reasonably needed to provide the features you request, save information you choose to keep, secure and maintain the service, and comply with applicable obligations, as described in the Privacy Notice.

As explained in the Privacy Notice, BrightThrough may use limited usage and feedback information for product improvement and benchmark development. Private workplace free text, Action Card text, custom wording, drafted messages, and private After records are excluded from analytics and benchmark datasets by default.

You are responsible for the content you choose to enter and for using the service lawfully, including where your content includes information about another person. Where practical, avoid entering unnecessary direct identifiers or sensitive details about other people.

7. Intellectual property

The BrightThrough system, its original text, structure, methods, tools, interfaces, branding, and other product materials are owned by or licensed to Maltzman Aizen Monica and are protected by applicable intellectual-property laws.

Your purchase or access gives you a limited, personal, non-exclusive, non-transferable right to use the service for your own workplace navigation and decision-support needs. You may copy or export material for your own legitimate use, but you may not reproduce, resell, republish, distribute, scrape, systematically extract, or build a competing product from substantial portions of BrightThrough without written permission.

8. Acceptable use

You may not use BrightThrough to break the law, violate another person’s rights, gain unauthorized access, interfere with product security or operation, distribute malicious code, abuse automated access, or intentionally use the service to harm, deceive, harass, or impersonate another person.

9. Purchases and access

BrightThrough is currently offered as a one-time purchase. Unless the checkout terms expressly state otherwise, your purchase includes lifetime access to the BrightThrough product you bought, with no recurring subscription fee for that purchase. Future separate products, services, or paid upgrades are not included unless expressly stated.

Purchases made through Gumroad are processed by Gumroad, which acts as Merchant of Record and handles payment processing and applicable transaction taxes. BrightThrough provides access to the product under these Terms.

Gumroad’s applicable terms are available at gumroad.com/terms. Refund and withdrawal rights are described in the BrightThrough Refund Policy, together with any mandatory rights and applicable Gumroad rules.

BrightThrough activates access after Gumroad confirms the purchase. A checkout confirmation displayed in your browser does not by itself activate access.

10. Third-party services

BrightThrough relies on third-party services for functions such as payment processing, sign-in, hosting, database infrastructure, transactional email, analytics, and public advertising attribution. Those providers have their own terms and privacy practices for the services they provide. The Privacy Notice explains the roles of the main service providers and the information BrightThrough shares with them.

11. Product availability and changes

BrightThrough may be updated, improved, reorganized, or temporarily unavailable. Features, guidance, interfaces, and content may change as the system evolves. Lifetime access does not mean that every feature, interface, script, or presentation will remain unchanged forever.

If a change materially affects the BrightThrough access you purchased, we will act reasonably and in accordance with any mandatory rights that apply. If the purchased product is ever discontinued, any remedy required by applicable law remains unaffected.

12. No guaranteed workplace outcome

Workplace situations depend on facts, people, organizations, law, policy, power, timing, and information that may be incomplete or change. BrightThrough cannot guarantee that a particular script, strategy, boundary, escalation, or decision will produce a specific workplace outcome.

13. Service disclaimer

To the fullest extent permitted by applicable law, BrightThrough is provided on an “as available” basis. We do not promise uninterrupted availability, error-free operation, or that every piece of guidance will fit every circumstance. Nothing in these Terms excludes warranties, consumer protections, or other rights that cannot legally be excluded.

14. Limitation of liability

To the fullest extent permitted by applicable law, BrightThrough and Maltzman Aizen Monica are not liable for indirect, incidental, special, consequential, or punitive losses arising from use of the service. For claims that may legally be limited, total liability will not exceed the amount you paid for the BrightThrough access giving rise to the claim.

These limits do not apply where applicable law does not allow them, including where liability cannot lawfully be excluded or limited.

15. Suspension, termination, and refunds

Access may be suspended or terminated for a material breach of these Terms, unlawful or abusive use, a serious security risk, non-payment where applicable, or discontinuation of the service. Where reasonably possible, we will provide proportionate notice unless immediate action is needed for security or legal reasons.

If a purchase is refunded, reversed, or successfully disputed, the access associated with that purchase may end in accordance with the Refund Policy, Gumroad’s applicable terms and policies, and any mandatory rights that apply.

16. Governing law and mandatory rights

These Terms are governed by the laws of Uruguay, without overriding mandatory consumer, privacy, or other rights that may apply to you in another jurisdiction. Nothing in these Terms limits rights or remedies that cannot lawfully be waived.

17. Changes to these Terms

The effective date of these Terms appears at the top of this page. If a material change requires renewed notice or acceptance, BrightThrough will provide that step before the changed Terms apply where required by law.
